It must be communicated clearly to all staff that discriminatory behaviour will not be tolerated and this policy is your first line of defence in the event of a complaint. Not having a policy may be construed as neglect or that the matter is unimportant to the organisation. With the flood of legislation and tribunal cases, this is not a risk you can afford to take. It is against the law for any discrimination on the basis of:

• Race
• Sex
• Sexual preference
• Religion
• Age

It is the responsibility of the employer to communicate what will and will not be accepted. This will prevent minor incidents growing into major problems and mis-understandings.
