Once a patent is granted, it will stop other people from using or selling the
invention without your permission for a period of time, usually 20 years. If
you disclose the subject matter of a patent before you have applied for a patent
without a strict confidentiality agreement in place, you may lose your right to register the patent.
A patent must be new: it must involve an inventive step, i.e. it must not be
obvious; it must be capable of industrial application, i.e. be capable of being
made or used. Your patent will allow you to stop others using your invention
unless you have agreed the terms on which they can use it.
A patent is an asset and like any other asset it can be bought and sold. This licence will grant a third party permission to use your idea providing you get a royalty or consideration in some form. This needs to be stipulated and the details need to be made clear.
Patent rights are territorial, i.e. if you register your invention in the UK,
your right is in the UK only and nowhere else. There are opportunities for
patenting on an international basis, for e.g. through the European Patent
Office in Munich.
